The nightmare continues for California Rapper Brandon Duncan, aka Tiny Doo. In an unbelievable court case that has the country baffled, the so-called gangster rapper is charged with gang conspiracy in the murder of 9 people since April 2013 and faces a sentence of 25 years to life in prison.
What makes this case difficult to believe is Duncan had nothing to do with the planning or execution of the murders.
All he did was produce a rap album. The prosecutor on the case discovered a law on the books in California that allows the prosecution of gang members who benefit from or promote the crimes committed by other gang members.

Friday January 23rd, 2015, Duncan appeared in court with the other 14 co-defendants charged in the case, but didn’t receive the verdict he expected, case dismissed. Instead the San Diego judge refused to dismiss the conspiracy counts against the rapper or his co-defendants. The judge stated he lack the jurisdiction to dismiss the case and allowed the prosecutors case to continue.
What is frustrating for Duncan and his co-defendants are 5 others charged under the same law had their court case dismissed by another judge.
There are a total of 33 people charged in this conspiracy case. However, since this is such a great number, they were split into two groups and assigned to two different judges. The judge not in charge of Duncan’s group allowed five of the defendants to walk free stating the prosecutor doesn’t have enough evidence to prove these individuals benefited from the murders.
Speaking with the media for the first time since he was arrested, Duncan voice his displeasure with his lawyer present.
“It sucks ’cause this is freedom of speech,” Duncan said. “Whatever happened to that? What happened to my constitutional rights?” – Brandon “Tiny Doo” Duncan
Duncan is out of prison on bail after it was reduced to $50,000. He spoke about just wanting to make music.
