Judge Tells Police Officer, “Your testimony is a stretch . . .” | In other words, “You’s a LIE!”, and “CASE DISMISSED”.

[Sometimes it is necessary to flash back to a moment when the law actually works for the people.]

Last fall, a St. Petersburg Florida police officer pulls over a green sport utility vehicle for a rolling right-hand turn at a red light according to the Tampa Bay Times. Emanual Bell, the driver produced his drivers license and was asked to exit the vehicle while the officer searched the middle console and found nothing. Bell refused further search of the vehicle and the officer went to his cruiser and began writing Bell a ticket according to the police report filed. Other officers converged at the traffic stop, which included Officer Brandon Bill, on 4th Street and 38th Ave N and reported a faint smell of marijuana and began a more detailed search of the vehicle. Officer Bill found cocaine behind the passenger seat and prescription pills in Bell’s pocket.

Bell 26, was taken to jail charged with drug trafficking. Wait a second though apparently bell had a “Get Out of Jail Free” card in his other pocket because after Judge Michael F. Andrews of the Pinellas County Circuit Court read the reports and heard the testimony;he had this to say.

It stretches the limits of credulity for this court to believe that the search of the defendant’s vehicle was based upon the odor of marijuana. Officer Bill’s testimony is discredited, controverted and contradictory within itself,’and as such incredible.

In other words, “You’s a LIE!”, and “CASE DISMISSED”.

Shut the front door and no he didn’t, say’s bay area defense attorneys. Jordan Tawil, who represented Bell say’s, “I have never, in 5 1/2 years of practice, seen a judge do this,” as reported by the Tampa Bay Times.

States Attorney personnel would like to down play the ruling, focusing on the facts of this case and the conflict in the evidence. MMMHHMMMM, mister State Attorney but we have seen you all along and now we are speaking from the bench.

It is worth noting the St.Petersburg police have not launched an investigation into officer Bill’s actions on this case or other cases he has been involved according to the Tampa Bay Times report.

Defense attorneys are celebrating this triumph.
