Obama Is ‘Irked And exasperated’ By Wiretapping Claim, So WILL He Sue Trump For Libel?

Barack Obama was reportedly “irked and exasperated” following the seemingly baseless accusations that he wiretapped Donald Trump at Trump Towers during the Presidential campaign.

Sources told CNN this but didn’t go as far as saying he was angry but sources told the Washington Post that the ex-press was livid! Anyhow, it’s a big accusation that seems to be one big publicity stunt!

The official response, from Obama spokesman Kevin Lewis, was that “neither President Obama nor any White House official ever ordered surveillance on any US citizen.

Any suggestion otherwise is simply false.”

“A cardinal rule of the Obama administration was that no White House official ever interfered with any independent investigation led by the Department of Justice,” said Obama’s spokesman,.

So what is Trump’s endgame here? Is he trying to burn Obama’s character, something that still holds strong with many. Is he trying to assert his dominance like an angry rooster!

But will Obama stand for this and should he? Is the accusation, if proven baseless, actually libel and should Obama consider suing?

Assuming Obama had the patience, and resources, to endure a lengthy legal battle, there is certainly a case to be made. According to Benjamin Zipursky, Law Professor at Fordham Law School, “to state that somebody has committed a crime when it’s false is clearly defamatory.” The issue, however, is proving that Trump knew his statement was false when he made the statement.

The Supreme Court has established two clear guidelines with respect to libel claims. The statement itself must be false, and the party making the statement must know the statement is false at the time the statement is made. Trump would presumably challenge the suit on the grounds of the second condition not being satisfied. He could argue that the intelligence presented to him suggested a link and broadly involved the previous administration.

Personally I think Obama should sue. He has a reputation to uphold and the problem with an accusation is that it stays with you, even if you are proven innocent. Trump knows this all too well, people will forever question if Obama did Wiretap Trump now, no matter what the outcome!

But Trump needs to be taught lessons, he needs to be fought, sued and hopefully taken down for this terrible behavior.
